These Terms of Service ("Terms") govern your access to and use of DruScan, a service provided by Menetray OÜ, a company registered in Estonia ("we", "us", "our"). By creating an account or using DruScan, you agree to be bound by these Terms.
Please read these Terms carefully before using the service.
1. About the Service
DruScan is a website monitoring service that scans Drupal websites and provides reports on performance, security, SEO, and configuration status. The service works in conjunction with a Drupal module that you install on your website to collect and transmit scan data to our platform.
2. Account Registration
To use DruScan, you must create an account by providing your name and email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
You must be at least 18 years old to create an account and use DruScan.
You agree to provide accurate and complete information when creating your account and to keep this information up to date.
3. Subscriptions and Payments
DruScan offers both free and paid subscription plans. Paid plans are billed on a per-project basis, meaning each project you add to the service can have its own subscription plan.
Paid subscriptions are billed in advance on a monthly or annual basis, depending on the billing cycle you select. Payment is required before the paid features are activated for your project.
All prices are displayed on our website and may be subject to applicable taxes depending on your location.
By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis until you cancel your subscription.
4. Right of Withdrawal
By subscribing to a paid plan and using the service, you acknowledge that the service is made available to you immediately upon payment. You expressly consent to the immediate provision of the service and acknowledge that you waive your right of withdrawal once the service has been activated.
As a result, payments for subscription periods that have already begun are non-refundable.
5. Changing Your Plan
You can upgrade or downgrade your subscription plan for any project at any time.
If you upgrade to a higher-tier plan, the price difference will be prorated and charged immediately. You will have immediate access to the features of the new plan.
If you downgrade to a lower-tier plan, you will retain access to your current plan features until the end of your current billing period. The downgrade will take effect at the start of your next billing cycle.
6. Cancellation
You can cancel your subscription at any time through your account settings. When you cancel, your subscription will remain active until the end of your current billing period. After that, your project will revert to the free plan or become inactive, depending on its configuration.
Cancelling a subscription does not delete your account or your project data. If you wish to delete your account and all associated data, you must contact our support team at [email protected].
7. Our Right to Suspend or Terminate
We reserve the right to suspend or terminate your account at any time if we detect a violation of these Terms, our Acceptable Use Policy, or any behaviour that we consider harmful to the service or other users.
In cases of serious or repeated violations, we may terminate your account without prior notice and without refund of any prepaid fees.
8. Use of the Service
You agree to use DruScan only for its intended purpose and in compliance with these Terms, our Acceptable Use Policy, and all applicable laws.
You may only scan websites that you own or have legitimate administrative access to. Authorisation is established by your ability to install and configure the DruScan Drupal module on the website.
You are responsible for ensuring that your use of DruScan complies with any agreements you have with your own clients if you are scanning websites on their behalf.
9. Intellectual Property
DruScan, including its software, website, documentation, and all related materials, is owned by Menetray OÜ and is protected by intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable right to access and use the service for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the service, nor may you reverse engineer or attempt to extract the source code of the software.
10. Data and Privacy
Your use of DruScan is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.
You retain ownership of any data you provide to DruScan, including scan data from your websites. We use this data solely to provide you with the service.
11. Disclaimer of Warranties
DruScan is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
The scan results and reports provided by DruScan are for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of any data, scores, or recommendations displayed by the service.
Every Drupal project is different, and what may be flagged as an error or warning in DruScan may not necessarily be a problem for your specific website. It is your responsibility to evaluate the scan results and decide what actions, if any, to take based on them.
We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the maximum extent permitted by law, Menetray OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of DruScan.
We are not responsible for any decisions you make or actions you take based on the information provided by the service. This includes, but is not limited to, changes you make to your websites, business decisions, or recommendations you provide to your clients based on DruScan reports.
Our total liability for any claims arising from your use of the service shall not exceed the amount you paid to us in the twelve months preceding the claim.
13. Changes to the Service and Pricing
We reserve the right to modify, suspend, or discontinue any part of the service at any time.
We may change our pricing or the features included in each plan. Any price changes will be communicated to you via email at least 30 days before they take effect. Price changes will apply to your next billing cycle after the notice period. Payments made before the notice will not be affected.
If you do not agree with a price change, you may cancel your subscription before the new price takes effect.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on our website. Your continued use of DruScan after such notification constitutes acceptance of the updated Terms.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Estonia.
Any disputes arising from or relating to these Terms or your use of DruScan shall be resolved exclusively by the courts of Estonia.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, Acceptable Use Policy, Data Processing Agreement, and Service Level Agreement, constitute the entire agreement between you and Menetray OÜ regarding your use of DruScan.
